The Supreme Court on Tuesday issued a show cause notice seeking clarification regarding the re-appointment of retired election commissioners Neellkantha Upreti, Dolakh Bahadur Gurung and Ayodhi Prasad Yadav at the Election Commission.
Justice Girish Chandra Lal issued the order asking the defendants to be present at the court with written explanation within the next fifteen days.
Stating that the appointment was against article 128 (7) of the interim constitution, the petitioners Hareram Sha and Prabin Kumar Lavh have demanded the termination of the appointments of former election commissioners.
President Ram Baran Yadav had appointed Neelkantha Upreti as the Chief Election Commissioner and four other commissioners on the recommendation of the Constitutional Council on 22 March.
